Abstract: The rules relating to the protection of women and children have never failed to ignite the interest of the general public. This paper opens with the history of the Women's Charter, in particular, section 106. Its roots clearly display lineage with the marriage and divorce laws of Kenya. Howerver, since Kenya largely derives its laws from England, our laws are effectively English. The essence of our thesis came in the form of a questionnaire administered to family lawyers.
